WARRANTY & ACCEPTANCE OF LIABILITY

This WoobaBike ™ product is covered by a limited replacement warranty against manufacturing defects for one year from the original purchase date (with proof of purchase) or subject to the time periods stipulated by the legislation in force in each country.  Should the product have a defect in materials or workmanship, we will repair or replace it without charge to you (a shipping and processing fee will apply).  To obtain service under warranty, simply contact our customer service center at customerservice@woobabike.com. All express and implied warranties for this product, including implied warranties of merchantability and fitness for a particular purpose, and limited to the warranty period, and no warranties (applicable per state), whether express of implied, will apply after this period.

This warranty does not cover damages resulting from misuse of the product, dropping, submerging in water, excessive force, improper maintenance or modification, consequential damages, negligence, theft, loss, natural disaster, accidents, or improper handling.

By purchasing and/or using the WoobaBike ™ product(s), user assumes any and all liability, responsibility, costs, claims, damages, settlements or legal fees resulting from use (or misuse) of the product. User understands that while the product may assist in alerting others and adding to rider enjoyment, it is not a substitute for riding safely, obeying traffic and noise laws, respecting others on the road, using the volume dial responsibly, riding defensively, avoiding dangerous road conditions, using one’s voice as an alert, or adding additional lights and warning devices.

By purchasing and/or using WoobaBike ™ Products, THE USER UNDERSTANDS AND ACCEPTS FULL RESPONSIBILITY AND LIABILITY for any accidents, damages, fault, injuries or other unfortunate results that may be caused to oneself or others when riding with and/or using WoobaBike products, including but not limited to, whether the product should run out of battery charge, fail to sound or respond, be played or turned up too loudly, be used in contrast to any noise or local laws, be played too close to any ears, detach from or move on the handlebar, distract rider or others, incite ‘road rage’ or altercations, or cause one to be entirely much too popular for his/her own good!

SEVERABILITY – If any provision of the above or below is declared or found to be unlawful, unenforceable or void, such provision will be ineffective only to the extent that it is found unlawful, unenforceable or void, and the remainder of the provision and all other provisions shall remain fully enforceable.

SAFETY INFORMATION – IMPORTANT!

It is the user’s responsibility and accepted liability to research and obey any local, state and federal laws regarding bicycle & road safety, as well as to obey any noise ordinances, accessory & safety requirements, restrictions, or allowances when attaching and using WoobaBike ™ products.

• USE RESPONSIBLY. Some sounds can be loud when played at full volume. For OUTSIDE USE ONLY. Do not play WoobaBike™ sounds directly into any ear or indoors. PROLONGED EXPOSURE AND INCORRECT OR RECKLESS USE MAY CAUSE PERMANENT HEARING DAMAGE AND/OR OTHER INJURY.

• Always Ride Safely. WoobaBike ™ sounds(c) are designed to help alert others and to heighten rider enjoyment, NOT to scare, harm or enrage others or animals. DO NOT USE IN ANY WAY THAT MAY DISTRACT NORMAL TRAFFIC FLOW, INTENTIONALLY SCARE, ENRAGE OTHERS, OR CAUSE ACCIDENTS OR HARM.  USER ASSUMES ANY AND ALL LIABILTY FOR DAMAGES AND/OR INJURIES TO THEMSELVES OR OTHERS WHEN USING WOOBABIKE ™ PRODUCTS INCLUDING IF UNIT MALFUNCTIONS OR DOES NOT SOUND. It is the user’s responsibility that he or she (and any dependents) operates WoobaBike products only if able to ride safely while avoiding distraction. Adult supervision required at all times for minors, as this is not designed to be a toy for use without adult supervision. WoobBike is designed for fun, and not to be relied on as a safety item nor to replace normal warning devices.

• Make sure to obey bicycle laws regarding attaching & using bicycle sound devices, accessories & allowed sounds in your area. Attach unit close to handle grips for ease & safety. ALWAYS PRETEST UNIT BEFORE EACH RIDE to make sure unit is functioning properly in case of need. NOT intended for use on motorcycles, motor vehicles, mopeds, strollers, trains, planes, boats or indoors.

• Do not submerge in water. WoobaBike ™ main unit is designed to be water resistant (IPX3 Rating), but IT IS NOT 100% WATERPROOF if submerged. Detach in heavy rain conditions.

• Extreme cold or heat may inhibit performance. Do not store WoobaBike ™ products outside in freezing weather or extreme heat.
